General terms and conditions
Introductory provision
These general terms and conditions apply to the sale of products by CEES via the ‘Webshop - puur.website’ to the customer. Applying for or placing an order on the website ‘Webshop - puur.website’ constitutes the acceptance of these terms.
The copyright provision applies to everyone.
CEES reserves the right to change and/or supplement these general terms and conditions at any time for future orders. Current orders are subject to the general terms and conditions that were applicable at the time the order was placed.
Definitions
In these terms and conditions, the following definitions shall apply:
‘ Webshop - puur.website ’ or simply ' website ' means the website of CEES where the homemade products are offered and sold.
' Customer ' means any person who applies for or places an order via the ' Webshop - puur.website '. Any person contacting CEES.
' Applying for an order ': the application by the customer to buy a product by CEES via the ' Webshop - puur.website ', whereby there is no payment by the customer.
' To place an order ': to purchase with immediate payment via the ' Webshop - puur.website ' of a product by the customer.
' Product ': the handmade bags and other articles of leather or wooden objects offered for sale by Cees via the ' Webshop - puur.website '.

These definitions also apply if the defined terms are used in these general terms and conditions in the plural form or with their past participle or in other variants.
Offers and formation of contracts
Offers are valid while supplies last. Most products are unique. If by chance a product is ordered by multiple people at about the same time, while the website has not processed yet the first purchase, only the order placed that reaches CEES first is binding.
If any payment happened, later customers will be refunded without delay and no later than within 14 days of payment.
An application for an order does not bind CEES nor the customer.
If no payment has happened (when applying for an order), the purchase will be complete only when CEES has been paid, after CEES sent the client an invitation hereto. The payment will be confirmed by CEES by sending an email to the customer.
The customer and CEES explicitly agree that a valid agreement is possible by using electronic means of communication. In particular, the lack of a written signature is without prejudice to the binding force of the agreement. As far as the law permits, the electronic files of CEES are a presumption of proof.
CEES reserves the right to refuse orders placed or applications for an order in the following cases
- when a product is not in stock,
- if abuse or bad faith may be presumed on the part of the customer,
- in cases of force majeure.
If a payment would have happened, CEES reimburses the customer immediately and at the latest within 14 days after the refusal.
Prices
All prices are in euro and include VAT. The price listed on the website or in the email to confirm an order is the total price payable by the customer.
CEES reserves the right to change the price of a product at any time. The price of the products is the price at the time the order is placed.
Payment
When placing an order the customer must immediately pay by HiPay or by bank transfer. When applying for an order the payment happens afterwards, after the customer received an invitation to pay from CEES.
Online payments are done via HiPay. It is possible to pay with credit card, Maestro, Bancontact, ...... ( HiPay ). A placed order will be handled as soon as a confirmation of the payment by the institution for the secure payment was received by CEES.
When paying by bank transfer the account number and the total price is communicated in the e-mail confirmation of the order. The order placed is sent to the client after the amount owed is credited to the account of CEES (see below).
For payment by bank transfer it is obligatory to use the IBAN and BIC code.

Delivery and delivery time
CEES strives to send orders placed and paid as soon as possible and if possible on the same or the next working day (in Belgium). These shipment terms are indicative and therefore no rights can be claimed by the customer, other than listed below.
If, due to problems with the delivery, the shipping takes longer than 15 working days after dispatch by CEES, the customer is obliged to inform CEES in writing stating his name and full address, e.g. via email. The customer has the right to cancel the order, also in writing, within 14 days after that. CEES then reimburses within 14 days the total price on the account that was specified by the customer when placing the order or on the account that the customer has specified in the cancellation.
If, in case of problems at CEES, the shipping takes longer than 15 working days after the order was placed, CEES informs the customer via email. The customer has the right to cancel the order in writing within 14 days after this notification. CEES then reimburses within 14 days the total price on the account that was specified by the customer when placing the order or on the account that the customer has specified in the cancellation.
Deliveries take place on the address indicated by the customer when ordering. CEES can in no way be held liable for errors or incompleteness in the delivery and/or in the billing address specified by the customer.
At the time of delivery to the address specified by the customer, the risk of the purchased products is transferred to the customer.
Shipping and handling cost
The shipping and handling cost will be charged. The amount may depend on the delivery address specified by the customer and/or on the method of shipment. The shipping and handling cost are listed before an order is placed.
Exchange
A customer can exchange a product within 14 days after the delivery, except for goods or products manufactured according to the specifications of the customer.
The customer must immediately inform CEES of this in writing and the product must be sent back to CEES within 14 days of the delivery. The customer must specify which product replaces the exchanged product.
Exchange is only possible if the product is not used and the packaging is undamaged and is sent back to CEES. If the customer wishes to exchange the product against a product with a different price the difference will be refunded by CEES or additionally billed as appropriate. The dispatch of the replacement happens after receipt by CEES of the product exchanged and after any payment of the higher price for the replacement.
The risk associated with returning a product for exchange is charged to the customer.
The cost of returning to CEES shall be borne by the client. At exchange CEES covers the shipping costs of the replacement once, with the exception of any additional costs as a result of the choice of the customer for a type of delivery other than the cheapest standard delivery method provided by CEES.

Right of withdrawal
Except for goods or products manufactured according to the specifications of the customer, the customer may, within 14 days after delivery, revoke the purchase without giving a reason and without penalty. The withdrawal is done in writing, for example by email addressed to CEES, within that period, or by using the form in annex which should be sent within that period to CEES. The written revocation mentions explicitly that it is a revocation.
The products must be returned to CEES immediately and at the latest within 14 days after the revocation.
Revocation can only if the product is not used and the packaging is undamaged and is sent back.
The cost of returning to CEES shall be borne by the client.
Immediately and at the latest within 14 days of receipt of the products by CEES, CEES repays the total price (including shipping costs, with the exception of any additional costs as a result of the choice of the customer for a type of delivery other than the cheapest standard delivery method provided by CEES) to the customer on the account number specified by the customer when placing the order or on the account number specified by the customer on revocation.
In the event of withdrawal, the customer must send the product back to us to the following address:

Conformity
Each product is handmade by myself using only natural materials. As a result, each product is unique.
If the delivered product does not match the requested or ordered product (non-conformity) a legal guarantee scheme applies according to Belgian law.
Manufacturing defects
Each product is handmade by myself using only natural materials. As a result, each product unique.
Without prejudice to the legal obligations under Belgian law, if it would turn out that a product has manufacturing defects, the customer must notify CEES immediately in writing (e.g. by email).
The customer must send the product back to CEES within 5 working days of the notification. The shipping cost will be refunded to the customer by CEES immediately after receipt of the products, with the exception of any additional costs as a result of the choice of the customer for a type of delivery other than the cheapest standard delivery method offered by CEES.
The customer can choose a new product from the same price without shipping costs. If a more expensive product was chosen the surcharge is invoiced to the customer, if a cheaper product is chosen the difference will be refunded. Refunds will be made within 14 days by CEES and/or will be deducted from the higher price of the replacement (shipping costs).
This provision does not affect the customer's right to withdraw from the purchase.
Exclusions – limitation of liability
Notwithstanding the foregoing, the customer is not entitled to any warranty:
-for normal wear and tear of the product,
-if the product has been modified or repaired,
-if the original invoice of the product cannot be submitted, has been modified or made illegible,
-in case of improper or abnormal use of the product, or
-in case of damage to the product by intent or negligence.
Outside the minimum legal obligations under Belgian law the seller's liability is always limited to the total price that was paid by the customer.
Data protection
For the communication with the customer and the smooth handling of the order CEES processes personal data.
CEES undertakes not to transfer personal data of the customers to third parties other than to the extent necessary for the sale. Personal data are not used by CEES outside the context of the professional relationship between CEES and the customer.
You can correct your personal data or have them removed in whole or in part at any time. This can be done by sending an email to mail@puur.website.

This applies to all photos and images without restriction.
No photo may be reproduced and/or made public by means of print, photocopy, photo of photo, microfilm, digital or any other means without written permission from CEES.
Any use of the website without prior permission may result in cessation or liability proceedings.

Jurisdiction and applicable law
If difficulties arise during the performance of a contract, the customer and CEES undertake seriously to reach an amicable settlement, before taking legal action.
If this does not solve the issue the courts and tribunals for the place of residence of the seller (186, Hasselbroekstraat 3890 Gingelom Belgium) are exclusively competent to hear any claims, irrespective of the place of delivery or the residence of the customer.
The legal relationship between the customer and CEES is exclusively governed by Belgian law, to the exclusion of its rules of private international law.
